These Terms of Service (“Terms”) govern access to and use of https://lumenatelier.pro/ (the “Site”) and the made-to-order lighting services offered by Lumen Atelier Ltd (“we”, “us”), registered in Israel, address: 9 Ahad Ha'am St, Tel Aviv-Yafo 6525101, Israel. By using the Site or submitting an inquiry, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Informational nature of the Site

Content on the Site (including collections, prices marked “from ₪”, lead times, and process descriptions) is for general information. Photographs illustrate style and atmosphere; finished custom pieces may differ based on your approved drawings and materials. We may update Site content without prior notice.

2. Inquiries are not binding contracts

Forms, emails, and phone calls are requests for information or quotes. A binding order is formed only when we issue a written confirmation, quote acceptance, or invoice that you accept according to its terms (including deposit, specifications, and delivery). Until then, either party may decline to proceed.

3. Custom products and specifications

Lamps are typically made to order. You are responsible for providing accurate dimensions, electrical constraints, and site conditions. Once you approve drawings and finishes, changes may affect price and lead time and may incur additional charges. Minor craft variations inherent to metalwork and glass are not defects.

4. Pricing, VAT, and payment

Prices on the Site are in Israeli New Shekels (₪) and are starting / indicative prices unless a written quote states otherwise. Quotes typically exclude VAT unless specified. Confirmed quotes and invoices prevail over website figures. Payment schedules (deposit and balance) are stated in the order documents. Title to goods may remain with us until full payment, as permitted by law.

5. Lead times and delivery

Stated lead times (e.g. 4–8 weeks) are estimates from design approval. Delays may occur due to material supply, custom glass, or force majeure. Delivery within Greater Tel Aviv or nationwide is arranged as set out in your quote. Risk of loss transfers according to the delivery terms agreed in writing. Installation by a licensed electrician is generally your responsibility unless we expressly include install services.

6. Acceptable use of the Site

You agree not to misuse the Site, attempt unauthorized access, interfere with security or availability, scrape content in a way that harms the Site, or submit unlawful, defamatory, or infringing content. We may suspend access for abuse.

7. Intellectual property

Site design, text, logos, and our original product designs are owned by Lumen Atelier Ltd or our licensors. You may not copy designs for commercial manufacture without our written consent. Project drawings we prepare for you remain our intellectual property; you receive a license to use them for the commissioned piece.

8. Warranties and consumer rights

We warrant that products will substantially conform to approved specifications and be free from material defects in workmanship under normal use for a period stated in your order documents (or, if silent, as required by mandatory Israeli consumer law). This does not cover misuse, improper installation, unauthorized modification, or normal wear. Nothing in these Terms limits mandatory rights of consumers under Israeli law, including the Consumer Protection Law where applicable.

9. Limitation of liability

To the maximum extent permitted by Israeli law, we are not liable for indirect, incidental, or consequential damages arising from Site use or from delays beyond our reasonable control. Our aggregate liability for a given order is limited to the amounts you paid us for that order, except in cases of willful misconduct, fraud, or liability that cannot be limited by law (including death or personal injury caused by negligence where such limitation is prohibited).

10. Privacy

Personal data is processed as described in our Privacy Policy, including the cookie preference key lumenatelier_cookie_ok.

11. Governing law and disputes

These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts of Tel Aviv-Yafo, subject to any mandatory venue or consumer protections that cannot be waived.

12. Changes

We may revise these Terms by posting an updated version on the Site with a new “Last updated” date. Continued use after posting constitutes acceptance of changes, without limiting rights that cannot be waived under Israeli law. Order-specific written terms control over Site Terms in case of conflict for that order.
